据纽约海事法庭报道伦敦商业法庭的裁决称当海盗截留船只时船东应和租船人一道承担损失，而这一裁定有利于租船人的利益。
法官主张，在合同中任意条款都应依据合同原意理解，而海盗属于“租金暂停事件”因此船东应对此负责而不是租船人。
问题在于确切的条款措辞为:
“当船只因任何事故或故障导致返航、在港在航时间损耗，船员或其他船上人员因疾病或意外事故导致航程偏差，船长或船员拒绝履行职责，燃油污染，以及所谓的被俘获，被任一主权拘留及胁迫，包括逮捕，从船只不能正常运转时起，到能正常使用或者回到停运位置或等距位置时止的时期（由租船人决定)内，租金停算。此后航行则恢复正常。在此期间所有的额外费用包括燃料费用应由船东承担。”
（"Should the vessel put back whilst on voyage
by reason of any accident or breakdown, or in the event
of loss of time either in port or at sea
or deviation upon the course of the voyage
caused by sickness of or accident to the crew
or any person onboard the vessel or by reason of the
refusal of the master or crew to perform their duties,
or oil pollution, even if alleged, or captureizure,
or detention or threatened detention by any authority including
arrest, the hire shall be suspended from the time of
the inefficiency until the vessel is again efficient in
the same or equidistant position in charterers' option,
and voyage resumed there from.
All extra directly related expenses incurred including
bunker consumed during period of suspended hire
shall be for owners' account." ）
而“被俘获，拘留及胁迫”这一表述则成了争论集中点。
船东方面表示，要属于“租金暂停”事件的范围，应该受到某一主权“俘获”。而租船人方面则成功地辩解称，“俘获”属于“租金暂停”事件的范围，因为据条款所言，“拘留及胁迫”才会涉及主权机构。并且海盗行为恰好符合“俘获”一词。
此前中远散货有限公司与Team-Up Owning Co Ltd因“Saldanha”轮曾发生纠纷，法院裁定此案运用的条款是相似的然而结果却大不相同。最终裁定海盗截留期间中远仍需向船东缴纳租金。
海事法庭表示，“本案有助于强调合同用语的重要性，以在海盗事件中分配风险避免后续争端。
